Penn Hills man charged in New Kensington shooting death

A Penn Hills man has been charged with first degree murder in the shooting death of a Pittsburgh man in Westmoreland County.

Daquane Faulk, 23, was arrested Friday for fatally shooting Todd Rogers, 25, on Moss Alley in New Kensington late Sunday, police said.

Police said Faulk was with Mr. Rogers and another unidentified man for several hours on Sunday before the shooting.

A witness told police that Faulk became more agitated throughout the day as Mr. Rogers was teasing him. According to a criminal complaint, at one point Mr. Rogers slapped the back of Faulk’s neck; another time Mr. Rogers punched Faulk in the face.

The three men were in the 300 block of Moss Alley about 11 p.m. when police said Faulk shot Mr. Rogers in the face and in the side. Mr. Rogers was flown to UPMC Presbyterian, where he died the next morning.

After being contacted by witnesses who identified Faulk as the shooter, New Kensington police obtained a warrant for Faulk’s arrest on charges of first degree murder, persons not to possess a firearm and unlawful body armor.

Faulk was spotted about 2:40 p.m. Friday at a home in the 1300 block of Swissvale Avenue in Wilkinsburg wearing a bulletproof vest and carrying a handgun, police said. When Wilkinsburg police arrived at the residence attempting to arrest Faulk, they said he tried to run away and threw the gun into a wooded area. But he quickly gave up and was placed in handcuffs, the criminal complaint said.

Police said Faulk was in possession of heroin and a bag of live ammunition when he was arrested. He was charged separately by Wilkinsburg police with persons not to possess a firearm, unlawful body armor, carrying a firearm without a license, tampering with evidence and drug possession.

Police said Faulk was taken to the Allegheny County Jail.

Court records show Faulk pleaded guilty to burglary, discharging a firearm into an occupied structure, possession of a firearm by a minor, reckless endangerment and aggravated assault in August 2010 and was sentenced to three years in prison. He had been released from prison May 7, according to police.

Faulk was also charged with attempted homicide and several other offenses in that incident, but all other charges were withdrawn.

Paperwork detailing what led to those charges was not immediately available.
