Judge won't order probe of Mt. Lebanon school board campaign

A Common Pleas judge today dismissed a petition that alleged filing irregularities and false information about who created and funded campaign post cards and signs in the Mt. Lebanon school board race in November.

Common Pleas President Judge Joseph M. James said the two Mt. Lebanon men who created the Save Mt. Lebanon Schools committee were not accurate record keepers, but that the misinformation in the filings did not rise to the level of being referred to the district attorney's office for a criminal investigation.

The men, Calvin Lynch and William Schmeltzer, were responsible for some 10,000 post cards that went out just days before the election urging the ouster of three incumbents. They were also responsible for about 90 signs with the same message posted at polling places. Two of the three incumbents lost.

In March, attorney Joseph Cavrich filed a petition in Common Pleas Court on behalf of five Mt. Lebanon residents asking for an audit of the committee with particular focus on an in-kind contribution from the committee of Allegheny County Controller Mark Patrick Flaherty.

Instead of granting an audit, Judge James held a 3 1/2 hour hearing today. The judge found that though there were discrepancies between Mr. Flaherty's committee and the Save Mt. Lebanon Schools committee on the amount of the in-kind contribution, there was no attempt to deceive because Mr. Flaherty included the contribution in his campaign finance report.
